H4 is a dependent visa so there isn’t much of questioning involved. All they have to make sure is that you are really married to the H1 visa holder and have no intention of seeking employment in USA. Be confident, make eye contact, be clear and loud enough. Keep your answers short and make sure greet them properly before and after the interview. Do not offer any informartion voluntarily, just answer what is asked.
1. When were you married?
Look into the interviewer’s eye and answer confidently, carry a few pictures of the wedding. If you have kids carry a few photographs of the entire family. It is important to remember the year.
2. Why are you going to USA?
To live with my husband/wife.
3. What are your qualifications?
Answer as briefly as as possible, they are not interested …they are just building up to the next question.
4. Do you plan to work there?
NO (firmly) as I suppose the law does not permit me to work.
5. Where in the US do you plan to stay?
Name of the place, or where my husband’s/ wife’s work takes him/her.
6. Do you plan to study?
Whatever you plans are…briefly.
7. If you didn’t take the H4 interview with your spouses’ H1B visa appointment?
8. Who filed the visa application and where did you file it?
the correct answer here would be – ‘ I filed it….’
9. Who will financially support you in the US?
10. Which company does your spouse work for or Who is sponsoring your husband’s H1 ?
11. How much he is earning or what is the annual income of your spouse?
Carry some pay stubs and recent bank statements.

If you have the contract , h1 papers, marriage certificates wou will be fine. If you have some paystubs and bank statements , just keep them with you….though you might not need them.

Hi there,
No. you will not need any letter. as long as you are on H4 , you cannot work and earn remuneration for it. they dont care if you quit your job or take a sabbatical or whatever… as long as you dont work in US for any monetary reward …you are good. The question of your employment should not come up.
you dont need to give out any details about L1 …unless they specifically ask about it.

My husband is currently in USA on F1-OPT and has H1B approval. The H1B approval would be valid from Oct. We got married in May, and he returned back to USA on his F1 visa. Hence, he doesnt have H1B stamping on his passport. I am willing to apply for H4 visa. Is it possible to apply for H4 visa without his passport having the H1B visa stamping? I have all other required documents like his pay-stubs, H1B approval etc.

welcome to the blog. As I keep mentioning the fact , that I am not expert on immigration issues. So any advise I give is based on my knowledge, reasoning and research.
And i think a copy of your husband passport with the visa stamp, will be required for u to obtain h4. H4 is totally dependent on h1 – its validity and existance… so an approval might not be enough. If you want further help, you will have to talk to a lawyer.

Thank you for such wonderful posts on visa. I have question on timing of H4 request. I am working on H1B since last 2 years and I got married in March 2008 but due to financial loans I did not ask my spouse to join. We did not process H4. Now we are planning it in coming January. If officer asks why did you not come for visa earlier, what should be the explanatory answer? Is explaining financial loan is justifiable? or I should prepare my spouse with some different answer? I have all other documents including wedding album, marriage certificate, pay stubs, w2 etc.

well, It is likely that this question might be raised during the interview. i joined my husband after three months and I was asked the reason for the delay. While Financial instability/loans seem like a good answer, it would be better if your spouse could add education/ examination/ or something on her part which caused the delay as the primary cause.
you need not worry, h4 visa cannot be denied if you provide the necessary documents required as proof of marriage.

My husband went to US on B1. After his stay in US for 5 months on B1 he came to know that even his H1 got approved. So he resigned his old job and joined a job on his H1. His H1 was not stamped. Now I am planning to go to US on H4 along with my child and I am going for interview with in 2days. Will my H4 will get rejected as his H1 stamping is not done? i am having all the other documents like his recent pay slips, Employee letter, passport copy, I94, I797, bank statements, marriage certificate, my son’s birth certificate etc. Do I need to attest any of these copies with attorny as my husband is in US? there is no need to provide evidence of your pregnancy but you should be ready for the unexpected so just keep some medical records with you during the
interview and also while travelling to US. visa processing hardly takes any time. If you have the baby in America then, the baby will be an american citizens but if you come later with the infant he/she might need a h4 visa too.

you will need to talk to a lawyer about that. i am not sure if you can be added , as there is some physical exam by a doc which needs to be done and lot of paper work to be submitted by all the parties applying for GC. only a qualified lawyer will be able to guide you.

well, you will not be asked for pay stubs while leaving the country…but yes, when your husbands applies for h4 visa make sure he has a copy of your employement contract, visa and marriage certificate ( i have listed other documents in the blog, kindly check!). Paystubs serve as additional proof they are not mandatory.

Hi Ramesh, why do you want to get an h4 just for visiting your wife? maybe a visitors/tourist visa….! if you are planniing to stay, I think you need to go back to your home country to get your h4….i am not too sure on this one.

I am in the US on a Visitor B1/B2 visa. I have a prospective employer who wants to sponsor my H1B visa and will file the peitition in August. I am engaged and will have my NIKAAH (Muslim wedding) while I am here and my would be spouse is in India (possibly over the internet or the phone).
In this case she won’t have a marriage album but only a marriage certificate from the court and possibly the wedding card.
I know it sounds weird but that is how my situation is. Do you think the marriage certficate will be proof enough for her H4 application?

it sounds quite exciting and not weird at all 🙂 …but your concerns are quite right, as wedding photographs are an important part of the visa issuance procedure. A marriage certificate is a good proof, but they might ask a few more questions about your whereabouts and why did u choose marry in an unconventional way… make sure your wife dresses up as a ‘very‘ typical married woman…basically, oozing her married status and is ready to answer all the questions confidantly.

one week does sound a little tight, you might get the visa in a week but if you are called again then, it will take a little longer. make sure you go well-prepared and leave no stone unturned…hopefully, your visa will be issued in the first try.

The primary applicant would be your spouse on h1B. You are not the primary applicant. Make sure , you have all the necessary documents esp. the ones related to your marriage and your husband’s h1b visa. Hope, i wasn’t late in posting my reply.

If you have your papers ready and have been approved…and you just need a stamping then, her visa cannot be denied. why was she denied a student visa? whatever the reason may have been…h4 cannot be denied , if you have h1b and proper marriage documents. good luck !

Also I have receipt of Tamil Nadu marriage notices because as per law we need to give 30 notice and register. Could you please advise can I submit mosque issued certificate and affidavit document is enough or need to wait still once get government certificate.

NO. When I got my visa ( 3 years back), i didn’t have to carry one. If your instructions dont tell you anything like this then, you dont have to !
at the same time, if you have any spare copies with you, just put them in your handdbag

Am getting married next month to an H1B visa holder. Have already filled out the DS-160 form and have scheduled the appointment as well.
Couple of questions :
1. I was working in the Bombay film industry for the past 6-plus years, as a freelancer. Have now left work due to the wedding and the upcoming shift. What is an ideal response to queries abt whether i wud work there?
a. Can i say – “not immediately, but maybe if/when i get a job sponsoring my H1”?
(I might be more suited – because of the nature of my work – for freelance work there, though.)
b. I plan to make documentaries. Wud that be an illegal thing to do as an H-4 holder? Then i wud not mention it in the interview.
c. Also, i do have plans for further study, which will be decided once i am there and can check out the options.
2. Slightly funny question – someone told me not to have Mehendi applied on the tips of my fingers because the Consulate would then not allow the fingerprints to be taken. Is this true? Shud i keep the tips clean? My interview is scheduled 4 days after the wedding, so the colour wud still be there.

I am a widow and an H1 visa holder since 2008. My first husband died last April 13, 2009. I got married for the second time last July 30, 2010. My first and second husband were both close friends. Last October 7 my 2nd husband applied for a visa but they put my husband into an investigation process since they thought our marriage is fixed. He was asked to go back to the embassy for the fourth time and keep on repeating the same questions. He was angry, mentally and physically drained but they still keep on questioning him about our marriage. We have much evidence/ proof to show to the investigator but still they keep on insisting that our marriage is fixed…Until now they hold on to his document and they told him that they’ll gonna ban him in going to US if they found any discripancies on our papers but God knows we got married in our own free will and all document were authentic. He was asked to wait for the call and the final say would be from the consul. They even told him that their recommendation is not to give him a visa…. my husband and I we’re both cryin…we don’t know why they’ve treated him this way. Please advice or enlighten us why this happening? Thank you.

I am Planning to get married in Nov, and wanted to bring my spouse along with me after the marriage. Now the Question is while i am filling the DS-160 form, it states maritial status, Married / Single, what should i put there as now i am single, but when i will go for Interview, i will be married.
As DS-160 form states, everything should be true while you electronically sign the Application.

I am facing my h4 visa interview on 28th february.I did a mistake in my ds 160 form.I was working in a US based company here but i was not on their payroll.I was recruited through a consultancy and was on their payroll.but in my ds 160 form i entered the company name , not the consultancy’s.the problem is that my experience certificate is issued by the consultancy as their employee, there is no mention about the company which i was working .Will that be a problem in the interview.will they ask for dependents experience certicates?Please advise…

My husband went to US on B1. After his stay in US for 5 months on B1 he came to know that even his H1 got approved. So he resigned his old job and joined a job on his H1. His H1 was not stamped. Now I am planning to go to US on H4 along with my child and I am going for interview with in 2days. Will my H4 will get rejected as his H1 stamping is not done? i am having all the other documents like his recent pay slips, Employee letter, passport copy, I94, I797, bank statements, marriage certificate, my son’s birth certificate etc. Do I need to attest any of these copies with attorny as my husband is in US? Pl reply ASAP.

My husband is current in OPT status and his H1B is under processing, I have applied for Masters in USA and will got admission. I dont know when he will get his H1B status ….and I also dont want to miss this 2011 Fall session…what should I do when I will get my I20 ….is their any risk if I stand for F1 visa while my husband is on the processing of his H1B?

I am on H1b and currently in US and my wife and kid appeared for H4 in april. they given 221g and on 19th 2011 april i submitted all the documents. on 5th june 2011 i received email from visa house that the visa is denied and returned by Kcc. First of all I have valid visa and after providing all the docs also they said it is refused. how will i know the reason and what would be my next step. very much frustrated . please suggest.

My husband is on h1b with company A. so i was on h4 till dec 2010. In december 2010 company B applied for my H1B. it got rejected in march 2011. Meanwhile company A forgot to file my h4 extension with my husband’s h1b extension.without knowing my h1b rejection Company A applied for my h4 extension as nunc pro tunc in may2011. even it got rejected. reason is uscis thought that we intentionally filed h4 because my h1b got rejeted. how can i explain the situation in my interview? do they trust me? do i have to provide any documents to support this? my interview is on 20th july 2011.

Hey, I am working in US since last Nov 2010 on H1B visa. I got married in June2011 in a chruch and got a marriage certificate from the church. But i didnt register my marriage in government registrar office in India and due to leave issues I flew back to US soon after marriage, I couldn’t get my Govt Marriage certificate at that time.
I am initiating my wife’s h4 visa now.
Will the christian cerificate work for H4 visa?Is there any alternative available if you don’t have govt marriage certificate? Does anybody have gone through this situation?

Im H1B here in the US. my wife applied for H4 visa but was denied
the reason is not sufficient income and below the minimum of 18,000 annual. they say its only 14.000/annual
im earning 14.50/hour and i work 32days a week.
base on my computation
14.50/hr x 32days = $464 a week
52week * $464 = $24,128 a year how come they come with 14,000 only. is it after tax?
please advice and do you think its a good idea to reapply again after 1month?
By the way im working in Texas. the minimum salary is 7.25 only

I have a question about my wife’s H4 visa. I understand that she should say a firm “no”, if she is asked about working here. Should we divulge about her career back in India in the DS-160 form then? Or should we just say that she does not work and is a housewife?

Has she applied to consulate at any point in time before? for any kind of VISA? If yes, what was mentioned in that? They have all records on finger tips provided by you earlier! what u told them etc. So if she is appearing to US embassy for the first time, you can say she was a housewife! They wud want to ensure 2 things: u ppl are genuinely married & u have proper H1 B – THATS IT! Good luck!

I am in a unique situation and after searching extensively I havent really found any solid answers.
I have been with my gf for past 1.5 yrs and she has entered US on J1 for internship at Google, B1/B2 ( she has 10 yrs multiple entry) in sept for interviews at google, jan to visit me and do some more interviews for 1 month, and now again in april for visiting usa ( entry valid this oct this year)
She was one of unfortunate person to not get selected in H1b lottery this year and might be possible that her offer from Google Inc expire.
I am really tired of living separately for extended periods of time and proposed her to get married to me ( H1b holder, never stamped but approval till oct 2014). She said yes and to avoid any immigration issues due to planned small court wedding on her B1/B2 visa .. we will follow 30/60/90 rule.
Question is :-
a) Is a court marraige or a very tiny wedding at a hotel be okay to process h4 visa ? since we dont plan of spending lot right now to plan family wedding in our countries.
b) When she returns back to macedonia, is it possible they would scrutinize her on entering usa on B1/B2 and getting married ? I see it online it is generally not a big deal since she is getting non working h4 dependent visa but I could be wrong. What kind of questions will she be asked.
c) Is it possible for her to be rejected for H4 visa ? if so does that affect her current B1/B2 visa (valid for 10 yrs multiple entry), since we are worried about not being able to be with each other for extended period of time.
d) If by any chance she is not able to enter US on H4 or B1/B2, is it still possible to process our I485 while she is in her country (with out H4) and she getting advance parole and travelling with that? ( my green card application is in process and I485 is not filed)

letbme brief u abt myself. i m applying for h4 visa on 9-12-2013. my husband is on h1 b status since 21-2-2012 n is in texas since den.we got married on 14-1-2012. i applied for my passport after that as i did not hd 1 earlier to marriage.we have a marriage certificate n his name appears on my passport. i got my passport on 11-5-2012 after which we applied for h4 visa in august 2012. we filled the visa fees n wen were abt to schedule visa appntment during dat time my mother inlaws met wid an accident n my mother in law had a big injury n had to go through a surgry n was asked by the dr for bedrest for 1 yr.
as my husband is d only son to my inlaws i had to stay back n tak care of dem so could not go foe interview in 2013.
now will the consulate ask tht y i did nt go to my spouse as v hv completed 1 yr n 10 months to our marriage.
n is dis reason justifiable.do let me know ………very tensed ……i hv all the other docs ready bt worried abt the gap period in between…….
